Court Urged To Acquit & Discharge Bob Keita

Lawyer K. Jallow, one of the counsels representing Bubacarr Keita (Bob Keita) has urged the court to acquit and discharge their client.
Lawyer K. Jallow made these remarks on Wednesday shortly after the state filed a nolle application to discontinue prosecuting Bob Keita.
“We are not objecting to the nolle filed. We are objecting to consequential order being a discharge only with acquitted. It is our position at this juncture considering the evidence before this honourable court particularly exhibit G, it is just improper that the accused person Bob Keita in the circumstances of the case my lord is acquitted and discharged.
“My lord we refer you to section 238 of the CPC that gives you the power to acquit and discharge the accused person Bob Keita. At this stage of the trial my lord, with or without a nolle, bearing in mind that PW8 (the alleged victim) had maintained that baby Muhammad is a consequence of the alleged rape,” she told the court.
Counsel K. Jallow further told that the evidence of the prosecution has been close and it has not in any way proven beyond reasonable doubt that Bob Keita is the father of the child.
“My lord, We urge the court to acquit and discharge Bob keita under section 238. And most importantly, it is the justice of the case on the principle of equity and fairness,” she said.
The proceedings is on at the time of publication and the judge was planning to make a ruling on the matter.
