Honorable Justice Ebrima Jaiteh of the High Court of the Gambia has ruled to admit the cautionary and voluntary statements made by Ousainou Bojang, who stands accused in the tragic deaths of two Police Intervention Unit (PIU) Officers at Sukuta Jabang Traffic Lights.
The cautionary and voluntary statements were obtained by a member of the Gambia Police Anti-Crime Unit (ACU), Detective Ebou Sowe.
During the proceedings, Counsel Lamin J. Darboe, representing Ousainou Bojang, requested a voire dire (trial within a trial) due to concerns about the circumstances surrounding the acquisition of Bojang’s statements by the police.
Allegations of coercion, including the use of drugs and physical abuse, were raised by Counsel Darboe against the police regarding the acquisition of his client’s statements.
Both the Prosecution and Defence called two witnesses to testify in the voire dire.
In delivering his ruling, Hon. Justice Ebrima Jaiteh of the High Court of the Gambia has admitted the statements of Ousainou Bojang, obtained by the Police.
Hon. Justice Jaiteh said the prosecution has proven Its case in the voire dire (trial within a trial) beyond a reasonable doubt.
