The Lawyer representing Aisha Fatty (1st defendant) Counsel Lamin S. Camara has told Justice Ebrima Jaiteh of the High Court of the Gambia that they will “vigorously” defend the civil suit against his client.
Aisha Fatty, a Gambian socialite has been sued by his ex-finance Abdoulie Thiam, (Plaintiff) a Senegalese business tycoon for allegedly breaching a marriage promise. In addition to Aisha, the Senegalese Business tycoon also sued the Inspector General of Police, Abdoulie Sanyang, who is the 2nd defendant in the civil suit.
The most talked about Civil suit was mentioned in court for the first time since the matter was reported by a local media house a few weeks ago.
When the matter was mentioned for commencement, Counsel L.A. Ceesay announced himself as representative of the plaintiff (Abdoulie Thiam) together with Counsels, K. Sanyang, L. Bojang, and I. Jobe. Counsel L. A Ceesay went on to inform the court that his client, the plaintiff (Abdoulie Thiam) is absent from today’s hearing.
Counsel LS Camara announced himself as the representative of the 1st defendant (Aisha Fatty) together with counsel F. Jallow. However, the Inspector General of Police, Abdoulie Sanyang, was not present in court and did not also have any legal representation at today’s hearing.
Counsel LS Camara told the court that he received the suit from the plaintiff on the 22nd of March 2023 and is within the mandated time to file a defense, which, he said, they intend to do vigorously.
“We acknowledge service of the originated processes filed by the plaintiff. We are served on the 22nd of March 2023 and my lord; we intend to vigorously defend this suit and we will do so. We are still in a time frame to file our defense, and we will file it within our time,” Counsel LS Camara told Justice Jaiteh.
Justice Jaiteh confirmed that the Inspector General of Police was served through one Abdouraham Barry on the 20th of March 2023, and he thinks the IGP is still on the statutory time.
“The IGP is not here, but that is his bread and butter,” Justice Jaiteh told the court.
Counsel LS Camara informed the Court that since he was served on the 22nd of March, the time for them to file their defense would be the 21st of April 2023. At this juncture, Justice Jaiteh informed the counsels that he will issue a hearing notice to the IGP, and a copy of the dates scheduled for the next hearings.
The Plaintiff’s claims against the defendants are for; A declaration that the Plaintiff is the bona fide owner of a white Mercedes-Benz GLE 53 vehicle with registration number BJL 0999 W and black Mercedes-Benz GLE 63 BRABUS vehicle with registration number BJL 4222 W; An order that the said vehicles mentioned above be released to the Plaintiff; and any further or other reliefs as the Court deems just.
