Prosecution Yet To File Bill Of Indictment Against Sainabou Mbye, 2 Others

The Office of the Attorney General (Prosecution) is yet to file a bill of indictment against Sainabou Mbye and 2 Others, as of today (18th day of August 2022), this medium is reliably informed.

Kerr Fatou has been further informed that the Prosecution has until 12:30pm tomorrow (19th August 2022) to file a bill of the indictment as ordered by Justice Jobarteh; else the accused persons would be granted bail.

The accused persons applied to be grant unconditional bail, as the State is yet to file an indictment against them; but their bail application was rejected by Sidi K. Jobarteh of the High Court of the Gambia  

Justice Jobarteh said the application lacks merits.

In the said hearing, Justice Jobarteh ordered the prosecution to file a bill of indictment before (Friday) 19th August 2022, failure of which the accused would be granted bail automatically, upon fulfilling the bonds.

The ex-wife of remanded Bob Keita, Sainabou Mbye, Cherno Mbye, and Kibili Dambelly are charged with manslaughter contrary to section 186 of Criminal Code Cap: 10.01 Vol.III, Laws of the Gambia 2009.

The particulars of the offence stated that Sainabou Mbye, Cherno Mbye and Kibili Dambelly, on or about the 3rd day of July 2022, at Kanifing and diverse places in the Republic of the Gambia, by unlawful act or omission, amounting to culpable negligence, left one Muhammad Mbye, a two-year-old boy resident of Brusubi inside a car which caused his death, thereby committed an offence.
