Abdoulaye Thiam’s civil lawsuit against Aisha Fatty, the first defendant, faced a setback at the High Court of The Gambia due to Fatty’s detention in Senegal.
Thiam, the plaintiff, is suing Fatty, his former fiancée, for allegedly breaking their engagement promise, which he claims has caused him significant emotional distress and embarrassment.
Thiam also asserts that he sent gold to Fatty for business purposes, but never received any payment for it.
Additionally, Thiam is pursuing legal action against the Inspector General of Police, who is the second defendant in the case.
When the case resumed on July 18, 2024, Counsel Kebba Sanyang, representing Abdoulaye Thiam, informed the court that Aisha Fatty’s lawyer, Lamin S. Camara, had shared with him a desire to consult with his client regarding the documents served, which included a WhatsApp conversation and an audio recording between Aisha Fatty and her former friend Aji Fama Taal.
In response, Counsel Lamin S. Camara confirmed to the court that he had indeed discussed this matter with Counsel Kebba Sanyang.
“I can confirm what my learned friend informed the court about their additional list of evidence. We were served with an additional list of evidence, my lord,” Counsel LS Camara told the court.
However, Counsel LS Camara told the court that he is yet to have a consultation with his client, Aisha Fatty, on the additional list of documents filed by Abdoulaye Thiam.
“I have not consulted with my client (Aisha Fatty) on the documents. I have been there (Senegal) severally, but they will not allow me to have a pre-trial with my client. These documents might not be bulky, but I don’t have access to my client on this. For the flash drive, I listened to it, but it is not in the language of the court,” Counsel LS Camara told the court.
Counsel Lamin S. Camara informed the court that he is hopeful that his client’s situation in Dakar will be resolved before the next adjourned date.
Counsel Kebba Sanyang then notified the court that the audio would be transcribed into the court’s language and served on the defendants.
Hon. Justice Ebrima Jaiteh responded by noting that the audio should have been transcribed prior to being served on the defendants.
The case was adjourned by Hon. Justice Jaiteh to July 25, 2024, for continuation.
