Abdoulaye Thiam, the plaintiff in a lawsuit against Aisha Fatty, has filed a motion with the High Court of the Gambia requesting that Mrs. Aji Fama Taal-Gaye be summoned to testify in the case.
In the motion, dated November 7, 2023, Thiam asks the court to order Mrs. Taal-Gaye to appear before Hon. Justice Ebrima Jaiteh and provide testimony about her knowledge of the case. Thiam also requests that the court issue any other orders it deems necessary.
The motion is accompanied by a 12-paragraph affidavit sworn to by Ousman Mbye, a clerk at Solie Law Chambers
“Mrs. Fama Taal a legal practitioner, is a friend of the 1st Defendant herein and has information regarding matters in issue in this suit, to wit: She bought some of the gold, the subject matter of the suit herein, from the 1st Defendant. She knows the origins of the gold she bought, and I believe she is still in possession of the same.
“The testimony of Mrs. Fama Taal-Gaye is necessary and will be immensely helpful as the court resolve the issues in controversy between the parties herein. Unless summoned to testify, Mrs. Fama Taal-Gaye will not, and crucial and important evidence that will be helpful to the court will be lost. It will be in the interest of justice to grant the application herein,” Ousman Mbye said on behalf of Abdoulaye Thiam (the Plaintiff).
Counsel LS Camara, representing Aisha Fatty, (1st defendant), informed the court that he would review the motion and respond to it.
The State Counsel also informed the court that she would examine the motion and determine whether or not a response was necessary.
Background of the Case
Abdoulaye Thiam, the plaintiff, is suing Fatty, his former fiancée, for allegedly breaching their engagement promise. He claims that the breach has caused him emotional distress and embarrassment. Thiam is also suing the Inspector General of Police, Abdoulie Sanyang, who is the second defendant in the civil suit.
