Golden Beach Hotel Files Over D2.9 Million Lawsuit Against Abdoulaye Thiam For Breach of Contract

Golden Beach Hotel has filed a civil lawsuit against Senegalese businessman Abdoulaye Thiam, for breach of contract.
In addition to Abdoulaye Thiam, Golden Beach Hotel is also suing Immo Land Sarl Hotel, purportedly owned by Thiam.
The hotel claims an outstanding amount of Forty-Three Thousand, Two Hundred United States Dollars ($43,200), which is equivalent to Two Million, Nine Hundred and Twenty-Eight Thousand, Three Hundred and Ninety-Eight Gambian Dalasis (D2,928,398), owed by the Senegalese Businessman.
According to the hotel’s legal documents, an agreement was reached with Abdoulaye Thiam and his Immo Land Sarl Hotel on February 9, 2023, for a one-year term. The agreement stipulated that the tenancy would commence on February 15, 2023, with an annual rent of One Hundred and Seventy-Two Thousand United States Dollars($172,800), equivalent to Eleven Million, Seven Hundred and Thirteen Thousand, Five Hundred and Ninety-Four Gambian Dalasis (D11,713,594).
Furthermore, Golden Beach Hotel asserts that this rent amount is payable monthly at Fourteen Thousand and Four Hundred United States Dollars ($14,400) per month, which corresponds to Nine Hundred and Seventy-Six Thousand, One Hundred and Thirty-Three Gambian Dalasis (D976,133).
The hotel stated that the negotiations for this agreement were conducted with Abdoulaye Thiam, who consistently presented himself as the owner of Immo Land Sarl Hotel.
However, the agreed-upon commencement date for the tenancy, according to the lawsuit, was later modified to June 1, 2023, instead of the initially proposed date of February 15, 2023.
Subsequently, the hotel alleged that Abdoulaye Thiam assumed control of the Golden Beach Hotel in June 2023 and fulfilled the rent payments due for the months of June, July, August, and September 2023.
Golden Beach Hotel relies on clause 6(a) of the tenancy agreement, which obligates Abdoulaye Thiam to pay rent each month. Additionally, Clause 13 of the agreement outlines provisions for re-entry (hotel takeover) if rent arrears remain unpaid for twenty-one (21) days.
The hotel’s owners now seek to reclaim the hotel located in Bijilo, within the Kombo North District, West Coast Region.
In addition to seeking the return of the hotel, Golden Beach Hotel also aims to be awarded profit and costs by the court.
