Yankuba Touray’s Lawyer Ordered To Provide Missing Pages Of High Court Judgement

The President of the Court of Appeal of the Gambia, Justice Na Ceesay Salla-Wadda has ordered the lawyer for Yankuba Touray to provide missing pages of the High Court’s judgement against his client.
On 14thJune 2021, the High Court of the Gambia found Yankuba Touray guilty of the murder of former Finance Minister- Ousman Koro Ceesay and sentenced him to death by hanging.
Almost a year later (6th of June 2022), Touray appeared in the Court of Appeal contesting his sentencing to death by hanging by the High Court.
In today’s hearing, the counsel representing the state, Muhammed B. Sowe, informed the court that page 14, 16, 17, 18, 19 and 20 of Yankuba Touray’s Lawyer brief of argument at the High Court are missing.
The state counsel further told the court that pages 4, 6, 7, 8, 35 and 61 of the High Court judgement are also missing.
The Court of Appeal President Justice Salla-Wadda then ordered Yankuba Touray’s Lawyer Abdoulai Sisoho to provide the missing pages of the High Court Judgement and his brief of argument he filed at the High Court to form part of the records as supplementary.
Justice Salla-Wadda again ordered Lawyer Abdoulai Sisoho to file supplementary and ensure service on the state counsel.
Muhammad B. Sowe, is the lawyer representing the state; while Lawyer Abdoulie Sissoho is representing Yankuba Touray in the case before Justice Na Ceesay Sallah -Wadda, President of the Court of Appeal of the Gambia, Justice Haddy Roche and Justice Basiru Mahoney.
The case is adjourned to 27thJune 2022 for proof of service and ordering of briefs.
Yankuba Touray, former Minister of Local Government and Lands under the APRC government was tried and convicted on a criminal charge of the murder of Ousman Koro, former Finance Minister of the Junta.
The trial was instituted against him after refusing to testify as a witness at the Truth Reconciliation and Reparations Commission (TRRC) on circumstances surrounding the death of Ceeaay in 1995; which certain TRRC witnesses alleged took place at Yankuba Touray’s house. The witnesses further alleged that Touray participated in the killing of the young man.
